How to apply for birth registration for legitimate children of foreign spouses and nationals?

1. Legal basis:Article 4, 6, 29, 47, 48, 49, 79 of the Household Registration Act, Article 10 of the Entry/ Exit and Immigration Act
2. Application procedures:
(1)Born domestically:Apply at local household registration office by the father, mother, grandfather, grandmother, householder, cohabitant or nurser.
(2)Born abroad: Householder or legal representative takes the residence permit(apply at National Immigration Agency according to Entry/Exit and Immigration Law )to apply for initial household registration at local household registration office.
(3)Cannot apply in person: You can authorize a commission. (If a commission is authorized abroad, it must be verified by the overseas embassies or missions.)
3. Required documents:
(1)Born domestically
1.Certificate of household registration, applicant national ID, seal
2.Birth certificate and child’s surname agreement letter.
(3)Born abroad
1.Apply for initial household registration with the certificate of household registration and ID, seal, residence permit of householder or legal representative.

3.Cannot apply in person: You can authorize a commission. (If a commission is authorized abroad, it must be verified by the overseas embassies or missions.)
4.Notes:
(1)After Nationality Act amended and promulgated on February 9, 2000, children born in Taiwan under the marital relationship between national women and foreign men can apply for birth registration in the household registry location of birth mother. Except for the minor children while the amended Nationality Act was promulgated, i.e. born before February 10, 1980, can apply for residence permit at National Immigration Agency, and then hold it to apply for initial household registration.
(2)When applying for birth registration and initial household registration of children, their names must tally with the national customs.
