1.Legal basis: Nationality Law and its enforcement rules
2.Requirements:
A Foreign spouse who has a residence inside the territory of the ROC (i.e. after obtaining an Alien Resident Certificate), legally stays in Taiwan for more than 183 days per year over a 3 year period, who are over twenty years old, have no record of delinquent behavior and no criminal record according to the police criminal record. Have considerable property or professional skills for self-reliance or proof of livelihood security with Taiwan basic language skill and common sense of national rights and obligations. Foreign spouses meeting the above condition can apply for naturalization. An applicant shall provide a certificate of loss of original nationality within one year from the day of the Ministry of the Interior’s permission for naturalization. For an applicant who failed to submit by the end of that period, the permission for naturalization shall be cancelled, except for those who are allowed to extend the time limits because the Ministry of Foreign Affairs has verified that the applicant cannot provide the loss of original nationality due to the law or administrative procedures of the country of origin.
3. Application procedures: The applicant can send the application to a city or county government and forwarded to the Ministry of the Interior.
4.Required documents:
1. Applicant naturalization form.
2. Valid Alien Resident Certificate or Alien Permanent Resident Certificate.
3.Police criminal record certificate issued by the country of origin, or other relevant documents (Applicants who were once a national’s spouse, and the marital relationship has been annulled without record of exit, are not required to submit a police criminal record certificate).
4.Considerable property or professional skills for self-reliance or proof of livelihood security (applicants who already obtained an Alien Permanent Resident Certificate or proof of quasi-naturalized ROC citizenship are not required to submit this documentation).
5.Documentation of basic language skill and understanding of the national rights and obligations of the naturalized applicant in accordance with Article three of the authorized standards. (Applicants who already obtained proof of quasi-naturalized ROC citizenship are not required to submit this documentation.)
6.One photo (specifications in accordance with the national identity card specifications).
7.Certificate fee (charged by the existing provision, please pay with postal order and mark the payee as Ministry of the Interior).
8.Other relevant documents.
Documents issued overseas shall be verified by the ROC’s overseas representative office and approved by the Ministry of Foreign Affairs. Documents issued by any foreign embassy or authorized agency in Taiwan shall be verified by the Ministry of Foreign Affairs. Documents written in foreign languages shall have attached Chinese translations verified by ROC’s overseas representative office and approved by the Ministry of Foreign Affairs or verified by a notary.
